Proceedings of a Commission convened at Hilton Head S.C. by virtue of the following order, viz:
Head Quarters Department of the SouthHilton Head, Port Royal S.C.October 29th 1862.
General OrdersNo. 43
Pursuant to Par. 5, General Orders No. 100 from A.G.O. dated Washington, Aug. 11, 1862 the following named officers are detailed as a commission for the examination of all commissioned officers who have returned to the Department having overstayed their leaves of absence, viz:
Colonel Jas. L. Fraser 47th N.Y. Vols.Captain A. B. Nicholson 47th N.Y. Vols.Captain Edward Eddy 47th N.Y. Vols.1st Lieut. Alex McAloney 47th N.Y. Vols.2nd Lieut. Henry G. Brotherton 47th N.Y. Vols.
The commission will convene from day to day at 9 o'clock A.M. and continue its sessions until 11 A.M. provided there be any business before it. The junior member will record the proceedings.

The Commission met pursuant to the above order:

Case of Captain John H. Gould, Co. "G" 3rd R.I. Arty.His statement: I took advantage of my leave of absence June 13th 1862. The said leave was granted for thirty days by order of Major Genl. D. Hunter. I proceeded north on the same day to Providence, R.I. Prior to the expiration of my leave, I applied by telegraph to Colonel Tompkins, Quarter Master at New York and receive no reply. I applied again through another officer. Answer was do not know when a steamer will sail. I then applied a third time through the same source and received an answer late at night that a steamer would sail next morning, which came too late for me to get transportation. Understanding that the steamer McClellan would soon sail, telegraphed to the 1st mate of the vessel inquiring of him when the steamer sailed. His reply was in a few days. I then proceeded to New York and remained there four or five days awaiting transportation to Port Royal and on the 21st July I took passage on the steamer McClellan and arrived at this post on the 24th July 1862. I applied to Colonel Tompkins on the 7th July 1862.
The foregoing statement being thus in possession of the commission the room was cleared for deliberation, and having maturely considered the case find that Captain John H. Gould, Co. "G, " 3rd R.I. Arty. was absent from proper cause.
